An amendment was proposed and approved on Friday 3 February concerning the reporting of new paid family and domestic violence leave on an employee’s payslip. This alteration became effective on Saturday 4 February.
Employers will need to keep a record of any leave taken and the balance remaining for their employees, but should not include any references to paid family or domestic violence leave on pay slips.
Beginning 4 February 2023, when an employee is given compensation for taking family and domestic violence leave, this must be reflected in their pay slip as:
ordinary hours of work, or
another kind of payment for performing work, such as an allowance, bonus or overtime payment.
If an employee requests it, their employer can note the taken time off as a different type of leave, such as annual leave, on their pay slip in lieu of family and domestic violence leave.
It is best practice for employers to record any paid family and domestic violence leave taken by an employee on their pay slip, so that it appears as close to normal as possible.
